Denver Divorce Papers 101

May 24, 2021

The decision to get divorced is rarely an easy one. Moreover, according to University Hospitals (UH), divorce tops the list of stressful life events, only surpassed by the death of a loved one.

Thankfully, filing Denver divorce papers can be reasonably straightforward if you and your spouse agree on major issues such as property division and parental responsibilities. You can then file the necessary paperwork in your local court and simply wait for the approval of your divorce.

However, if you and your spouse disagree on certain issues, as is often the case when it comes to the dissolution of a marriage, the legal process can become more complex and challenging. You may need to attend mediation sessions to come to agreements on contentious issues or have a judge decide the terms of the divorce.

Therefore, if there are disagreements between you and your spouse or you are worried about fair treatment with financial and child custody matters, seeking guidance and advice from an experienced family lawyer can help ensure your legal and financial rights remain protected. Contact Johnson Law Group for advice and help today at (720) 463-4333 or text-to-chat (720) 730-4558.

Where Can I Find Denver Divorce Papers?

Provided you and your spouse agree on all matters, you can potentially complete and file Denver divorce papers yourself, which can be the least stressful and least expensive way of divorcing. The Colorado Judicial Branch provides an excellent online resource for Denver divorce papers and other documents you may need, depending on your unique family circumstances.

An attorney from our office can help you with finding and filing the applicable divorce documents. Moreover, they can ensure that the paperwork is completed correctly and accurately, which can help speed up the divorce, allowing you to move on with your life.

Do I Have to Go to Court for a Divorce in Denver?

If you and your spouse agree on every single aspect of the divorce, you may not need to go to court, as you can file what is called an “uncontested divorce”. This means both parties agreeing on issues such as:

  • Parental responsibilities and child custody
  • Child support and spousal support payments
  • The division of all marital property and debts

While there is no need to go through the courts with an uncontested divorce in Denver, also called a “decree upon affidavit,“ you will have to fulfill specific requirements, including:

  • Both spouses agreeing that the marriage is irretrievably broken
  • Having been resident in Colorado for more than 90 days
  • You both signed a separation agreement detailing how the property is to be divided between you, or you do not have any common marital property
  • You have no minor children, or you both signed a separation agreement dealing with child custody and financial support matters

If you are filing for the divorce on your own, you will also have to provide evidence of having served your spouse with the affidavit. A judge will typically approve the divorce with a “decree of dissolution of marriage” after 91 days unless there is any discrepancy with the paperwork or they believe one party has been unfairly treated with the separation agreement.

Denver Divorce Papers for an Uncontested Divorce

If you are filing for an uncontested divorce, you must submit an “affidavit for decree without appearance of parties” in the Denver county district court. You can file the affidavit alone or with your spouse. It is important to note that Denver divorce papers must be delivered personally to court and cannot be filed online. If you are filing on your own, you will have to serve your spouse with the affidavit. However, if you are filing together with your spouse as co-petitioners, serving is not necessary.

Although it is possible to get an uncontested divorce without legal representation, it can be a valuable step to have an experienced family law attorney look over your Denver divorce papers, particularly the separation agreement, to ensure its legal validity and acceptance by the court.

The compassionate legal team at Johnson Law Group can assist you with all aspects of an uncontested divorce. We would welcome the opportunity to visit with you about all of your questions and legal needs regarding your divorce.

What Is a Mediated Divorce?

If you are unable to agree with your spouse on some issues, and an uncontested divorce is not an option, a mediated divorce can potentially provide a quick way and inexpensive way to reach an agreement and push forward while keeping the divorce out of court.

A mediated divorce typically entails hiring a divorce attorney to act as a mediator, helping both spouses resolve any stumbling blocks and coming to agreements on all contested issues. An attorney can then draw up the appropriate paperwork to finalize the agreement and initiate the divorce.

How Do I File Divorce Papers?

The procedure for filing Denver divorce papers is done once you have completed all the appropriate paperwork. You can file the completed paperwork with the clerk at the counter of the Denver county courthouse either on your own or together with your spouse.

Depending on your case, the clerk will provide you with a case management order, which can include other forms you may have to complete, information on any additional requirements, and deadlines. You will also need to pay a filing fee at the courthouse.
