Who Gets the Kids? The Battle of Child Custody

Custody battles can be some of the most contentious and emotionally charged legal proceedings, especially when celebrities are involved. In Colorado, like in most other states, the courts are required to decide custody cases based on the child's best interests. This means that there is no automatic presumption in favor of either parent, and the courts will consider a variety of factors, including the child's relationship with each parent, the parent's parenting skills, and the child's needs.

While it can be less common for fathers to win custody cases than mothers, it is still very much possible. Here are three famous Colorado family law cases where the father won custody over the mother in the trial:

1. Usher Raymond v. Tameka Foster Child Custody Case

In 2011, R&B singer Usher Raymond won primary custody of his two sons, Usher Raymond V and Naviyd Raymond, in a highly publicized custody battle with his ex-wife, Tameka Foster. Foster had accused Usher of being an absent father and using drugs, but the court found no evidence to support these claims. The court also found that Foster had a history of erratic behavior and that she had made false allegations of abuse against Usher.

In its decision, the court found that Usher was the more stable and fit parent for custody of the children. The court noted that Usher had a close relationship with their sons and was financially able to provide for them. Ultimately, Usher was awarded primary physical custody due to what the judge deemed “the best interests of the minor children.” 

2. Tyga v. Blac Chyna (Angela) Custody Case

In 2017, rapper Tyga filed for full custody of his son, King Cairo, with his ex-fiancee, Blac Chyna. Tyga alleged that Chyna was not a fit parent and that she was putting King Cairo at risk. Chyna denied these allegations, and she countersued Tyga for full custody of King Cairo.

The custody battle was long and bitter, and both sides made serious allegations against each other. In the end, the court granted Tyga primary custody of King Cairo. The court found that Chyna had a history of substance abuse and that she had not always prioritized King Cairo's needs. The court also found that Tyga was the more stable and fit parent to have custody of King Cairo. More recently, Angela has transformed her image and, in an interview, discusses how her main priority is her kids. 

3. Dwyane Wade v. Siohvaughn Funches

In 2011, Miami Heat basketball star Dwyane Wade won full custody of his two sons, Zaire Wade and Zion Wade, in a custody battle with his ex-wife, Siohvaughn Funches. Funches had accused Wade of being a neglectful parent and of using drugs. Wade denied these allegations, and he countersued Funches for full custody of the children.

The custody battle was long and bitter, and both sides made serious allegations against each other. In the end, the court granted Wade full custody of the children. The court found that Funches had a history of mental health troubles and that she had tried to alienate the children from their father. The court also found that Wade was the more stable and fit parent to have custody of the children.

Finding the best interests of the minor children

These three cases show that fathers can win custody battles in Colorado, even when the mother is a celebrity. However, it is important to note that each custody case is different, and the courts will decide each case based on the specific facts and circumstances.
